These Terms and Conditions of Sale (hereinafter “TCS”) apply to any order placed on the website marchat-peintre.fr (hereinafter “the Site”), published by [Full name of the artist or company], operating under the legal status of [sole trader / company], whose legal information is as follows:


1. Purpose

These TCS define the rights and obligations of the parties within the context of the online sale of original artworks and/or reproductions offered on the Site.


2. Products

The products offered for sale are original artworks created by the artist.

Each product page includes:

  • a detailed description,

  • dimensions,

  • the technique used,

  • the price,

  • non-contractual photographs (possible variations depending on screen and lighting).

The artist guarantees the authenticity of the original artworks.


3. Prices

Prices are indicated in euros (€), all taxes included (VAT included).
Shipping fees are indicated at the time of the order and may vary depending on:

  • the destination,

  • the size of the artwork,

  • the carrier.

marchat-peintre.fr reserves the right to modify its prices at any time, while ensuring that the price applied is the one in effect at the time of the order.


4. Orders

The customer declares that they have read and accepted the TCS before final validation of their order.

The ordering process includes:

  • selecting a product,

  • adding it to the cart,

  • entering personal information,

  • choosing the delivery method,

  • validating the payment.

The order is considered final once payment has been confirmed.

marchat-peintre.fr reserves the right to cancel an order in the event of a payment issue or a prior dispute with the customer.


5. Payment

Accepted payment methods:

  • bank transfer

No banking information transits through the Site.


6. Delivery

6.1 Delivery Times

Original artworks are shipped within 3 to 15 business days, unless otherwise stated.
Delivery times vary depending on the carrier and the destination.

6.2 Packaging

Artworks are carefully packaged:

  • rigid protection,

  • reinforced parcel,

  • transport insurance (if applicable).

6.3 Risks

The risk of loss or damage is transferred to the customer once the parcel has been handed over to the carrier, unless otherwise required by law.

In case of a damaged parcel, the customer must:

  • refuse the parcel, or

  • issue specific written reservations to the carrier.


7. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

Exceptions (Article L221-28):

The right of withdrawal does not apply to:

  • custom or personalised artworks,

  • creations made to order.

Procedure

To exercise the right of withdrawal, the customer must send a request by email to:

The product must be returned in its original condition and packaging.
Return shipping costs are the responsibility of the customer.

The refund will be issued within a maximum of 14 days after receipt of the returned item.


8. Claims and Returns

In case of damage during transport, an investigation will be opened with the carrier.


9. Intellectual Property

All artworks, photos, videos, logos, and texts appearing on the Site are protected under the French Intellectual Property Code.

Any unauthorised reproduction, distribution, or exploitation is strictly prohibited.


10. Personal Data Protection

marchat-peintre.fr collects and processes personal data in accordance with the GDPR.

The information collected is used exclusively to:

  • process orders,

  • provide customer service,

  • fulfil legal obligations.

11. Force Majeure

marchat-peintre.fr cannot be held liable for any failure to perform resulting from a force majeure event (strike, natural disaster, war, etc.).


12. Applicable Law and Disputes

These TCS are governed by French law.

In the event of a dispute and in the absence of an amicable resolution, French courts shall have exclusive jurisdiction.

The customer may contact a consumer mediator free of charge in accordance with Article L612-1 of the French Consumer Code.
